Divorce in Florida from an Alien Spouse?

I started the divorce process and am about to file a default against my husband, from Hungary, who isn’t responding to anything. He has just been ignoring the documents sent to him. He never obtained his green card because we separated shortly after the marriage do to his infidelity. How long does it typically take for the process to be finalized when the other spouse isn’t compliant and does him not being legal here have anything to do with the time it takes?

His immigration status is irrelevant if he does not answer the complaint. If he were fully participating it might cause delays because of his need to get travel documents to come to the U.S. for court. The amount of time it will take depends on how busy your courts are but a default divorce shouldn’t take more than two or three months.

Does online infidelity hold up in court?

Does cheating online hold up in court?
My brother’s wife is having an “online affair” and I want to know if it holds up in court.
They live in Wyoming but the man whom she is cheating with lives in Florida.
If she moves there will the divorce be hell?
And SHE has a child from a prior relationship, but he as not yet adopted her…. they were in the process of it a few years back, but our mother talked him into waiting until the child is a teenager.

The courts no longer care who does what to whom, most states are no fault divorce states now. He should just file in his home state. florida is also a no fault divorce state.

Legal and color vision question?

Amanda and Phil both have normal color vision, but Amanda’s father was colorblind. Carissa, their first child, was two when they discovered she was colorblind. Phil sued for divorce on grounds Of Infidelity. Without doing any expensive genetic testing, did Phil have a case? Why or why not?

No Phil did not have a case. If Phil was interested in his wife he would have done some research into his own background to see if colorblindness was a trait in his previous family. It’s not a sign of infidelity.

Why would a person deny divorce in New York but grant it in Tennessee?

I have a female friend of mine who is currently living in New York with a service member. She has three children. She asked for a divorce in New York, but was told that if she moved back to her home state of Tennessee with him that he would divorce her. She has had an extra marital affair. Is there any legal reason why this would be more beneficial to him in one state as opposed to another? And is an extra marital affair in New York and then moving back to Tennessee enough to make it worth his while to wait until they move?
There is plenty of evidence for emotional abuse on his side and enough evidence Of Infidelity on hers.
Could this simply be a way of tipping the scales in a “no fault” state where equitable division is the usual course to a state where infidelity may have a larger implication on alimony, child support, and property distribution?

If she moves back to Tennessee with him, she’s going to have to live there a certain number of months before she can file for a legal separation. Then the separation has to be in force for a minimum amount of time before a divorce will be granted.

I suspect that her husband wants her to move back with him so that he will be able to control her simply because the children are physically with him.

Tennessee is a no-fault state. But, depending on the judge, her infidelity can most assuredly be used to affect the financial and custody settlements. New York – I don’t have a clue.

She obviously has a lawyer already. This is an issue she needs to discuss with him. The lawyer is going to be the expert in what conditions affect property division, and he should have contacts in Tennessee who can give him the appropriate information for that state’s laws. This isn’t a decision that she should make out of spite, or just to get even with her husband.

And, if he has a history of being abusive toward her or the children, there’s the safety issue.

Lawyer. That’s what they’re for.

How soon after a divorce can one re-marry in Pennsylvania?

A friend of mine just filed for divorce in the end of March; both her and her husband agreed and the divorce should be final in 3 months as there was nothing to fight over. She has been separated from her husband for 1 year already out of their 3 year marriage due to some infidelity on his part. During their separation period, she met and got engaged to someone else. She is currently planning her wedding to this gentleman. So, how soon after her divorce is finalized can she apply to re-marry? Thanks for any advice.
